These Terms of Service ("Terms") govern your use of the CoupleStars mobile application and website (the "Service"), operated by Cristian-Andrei Milea PFA ("we", "us", "our"), based in Romania, European Union. Cristian-Andrei Milea PFA acts as the operator and data controller of the Service.

By creating an account, downloading, accessing, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must stop using the Service immediately and delete your account. Continued use of the Service constitutes your ongoing acceptance of these Terms as they may be updated from time to time.

1. Eligibility

You must be at least 18 years old to use CoupleStars. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and complete information when creating your account.
You are responsible for all activity that occurs under your account.
You may only create one account per person.
You must notify us immediately if you suspect unauthorized access to your account.

3. The Service

CoupleStars is a relationship wellness tool that helps couples build daily rituals through mood check-ins, guided reflections, weekly alignment exercises, and a visual constellation reward system.

The Service is currently offered free of charge. We may introduce paid subscription tiers in the future. If we do, we will provide advance notice and any paid features will require your explicit consent before being charged.

4. Not Medical, Therapeutic, or Professional Advice

CoupleStars is NOT a substitute for professional help. Please read this section carefully.

The Service does not provide medical advice, psychological counseling, therapy, or any form of professional relationship guidance under any circumstances.
No content, feature, prompt, or output of the Service should be interpreted as a diagnosis, treatment recommendation, therapeutic intervention, or professional opinion.
The Service is not operated, supervised, or reviewed by licensed therapists, psychologists, psychiatrists, medical doctors, or any other healthcare professionals.
The reflection prompts, alignment questions, and other content in the Service are general wellness tools, not clinical instruments.
We make no claims regarding the effectiveness of the Service in improving, maintaining, or assessing the health of any relationship.
If you or your partner are experiencing domestic violence, abuse, a mental health crisis, or any situation requiring professional intervention, stop using the Service and contact a qualified professional or emergency services immediately.

By using the Service, you acknowledge that you understand and accept this limitation.

5. Acceptable Use

You agree not to:

Use the Service to harass, abuse, stalk, or intimidate your partner or any other person.
Use data obtained through the Service (such as your partner's moods, check-ins, or reflections) to manipulate, guilt-trip, or weaponize against your partner.
Impersonate another person or create an account on someone else's behalf without their knowledge.
Attempt to access another couple's data or circumvent security measures.
Use the Service for any unlawful purpose.
Reverse-engineer, decompile, or attempt to extract the source code of the Service.
Use automated systems (bots, scrapers) to access or interact with the Service.

We are not obligated to monitor user content or interactions within the Service, but we reserve the right to do so and to take action (including account suspension or termination) if we become aware of any violation of these Terms.

6. Couple Data and Shared Access

CoupleStars is designed for use by couples. When you link with a partner, certain data becomes visible to both members of the couple by design (see our Privacy Policy for details).

By using the Service with a partner, you consent to sharing the data described in our Privacy Policy with that partner. You are responsible for linking only with a partner who has also consented to this sharing.

If your couple relationship ends, either partner may delete their account. Shared couple data may be retained for the remaining partner's use of the Service, subject to applicable data protection laws and as further described in our Privacy Policy.

7. Your Content

You retain ownership of all content you create within the Service, including check-in notes, alignment responses, and any other text you enter.

By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you and your partner. We do not use your content for advertising, AI training, or any purpose beyond operating the Service.

8. Intellectual Property

The Service, including its design, code, visual elements, constellation system, prompts, and all other original content, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available." The Service is continuously evolving and may contain bugs, errors, or incomplete features. We make no guarantees that it will be uninterrupted, error-free, or that it will produce any particular result for your relationship.

We do not guarantee any improvement in communication, relationship satisfaction, or outcomes of any kind. You are solely responsible for any decisions, actions, or outcomes resulting from your use of the Service.

You agree that you do not rely on the Service as a substitute for professional judgment or advice.

We are not liable for any indirect, incidental, or consequential damages, including but not limited to emotional distress, relationship outcomes, decisions made based on content in the Service, actions taken by your partner based on shared data, or loss of data.

To the extent permitted by law, you agree to provide reasonable evidence supporting any claim for liability. Dissatisfaction with the Service or its features does not constitute a valid claim.

Our total liability for any proven claim shall not exceed the total amount you have actually paid to us for the Service in the twelve (12) months preceding the claim, or zero (EUR 0) if you are using the Service for free - whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless CoupleStars and its operator from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from or related to:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any applicable law or third-party rights
Content you submit through the Service

11. Account Termination

By you: You may request account deletion at any time by emailing hello@couplestars.com. Account deletion is permanent and irreversible. See our Privacy Policy for details on data deletion.

By us: We reserve the right to suspend or terminate your account at any time, with or without notice where reasonably possible, if we reasonably believe you have violated these Terms, engaged in abusive behavior, or if continued access poses a risk to the Service or other users.

12. Availability and Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to technical failures, outages, natural events, or third-party service disruptions.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

For EU consumers: You retain the benefit of any mandatory consumer protection provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer under applicable EU law.

Any disputes arising from these Terms or your use of the Service shall be resolved first through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Romania.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr .

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
